X1 Discovery, Inc. (“X1”) respects the privacy of your information. This Privacy Policy describes how we collect, use, disclose, and safeguard your information when you use the X1 Search product (the “Software”) and about the use of Application Programming Interfaces (APIs) published and provided by platforms such as Microsoft, Google, Dropbox used by the software. By using X1 Search, you consent to the data practices described in this Privacy Policy.

The Software is licensed to end users for its intended purpose to provide a seamless search experience across a user’s authorized data sources. The Software uses APIs from these providers, which are governed by their terms and conditions. For information on the terms and conditions of these third parties, please visit their websites. Some links are provided below for your convenience. These APIs are used solely with your explicit authorization and only for the purpose of providing the search features. Via the APIs, the Software provides its licensed end users with the ability to index and search data sources authorized to the user. The APIs work within the privacy settings of the account holders, and accordingly, the Software does not access data not authorized by the privacy settings of those account holders.

INFORMATION WE COLLECT

X1 Search collects information to provide a seamless search experience across your data sources. The types of information we collect may include:

  • Counts of Data Sources and User Actions: To improve our product, we collect anonymized data about the number of data sources and how users interact with features. This data is anonymized and not used to personally identify users.
  • Diagnostic Data: To enhance product performance, we collect diagnostic information like error logs, system metadata, and application usage statistics. This data is anonymized and aggregated, emphasizing that it does not personally identify users.

The Software does not collect or store passwords of account holders in any manner.

You remain in full control of your data, including what is indexed, searched, tagged, or exported through the Software. X1 does not access or store your content unless you explicitly share content for support purposes. The licensed end user of the Software maintains custody and control of data indexed, searched, tagged, and exported for search productivity. X1 only has access to limited information when the licensed end user requests technical support and shares content with X1 customer support.

HOW WE USE YOUR INFORMATION

  • Product Improvement: Diagnostic and usage data help us understand product performance, resolve technical issues, and improve our services.
  • Support: We may use collected information to provide technical support, answer your questions, and address issues raised by users.

ARTIFICIAL INTELLIGENCE (AI) FEATURES

X1 Search includes AI features that provide categorization, analysis, and related capabilities.

Locally-Deployed AI.

X1 licenses and distributes portable, frozen (no active training) Large Language Models (“LLMs”) and Small Language Models (“SLMs”) from providers such as Google, LLC (Gemma) and Meta (Llama) that enable AI-driven categorization and analysis to supplement the Software. These LLMs are deployed alongside the Software within your computing environment and are not hosted by X1. Consistent with the rest of this Privacy Policy, X1 does not obtain your indexed content through these features and does not use your content to train, fine-tune, or improve these or any other AI models.

External AI Services and Connectors.

At your election, the Software may connect to or interoperate with external, third-party AI services, models, or platforms — including through connectors or APIs — that are hosted and operated by third parties (such as Anthropic, OpenAI, Google, or Microsoft) (“External AI Services”). As with the other third-party APIs described in this Privacy Policy, External AI Services are governed solely by the applicable provider’s terms of service and privacy policy, and not by this Privacy Policy. When you enable such a connection, the Software transmits only the data, search results, or file references that you or your authorized users direct it to transmit, and you are responsible for determining whether particular data is appropriate to send to an External AI Service. X1 does not control, and is not responsible for, the data practices of any External AI Service.

Your Content Versus Diagnostic and Licensing Data.

As described under “Information We Collect,” X1 collects limited diagnostic, usage, and licensing data — such as anonymized error logs, system metadata, application usage statistics, and license validation information — to operate, support, and improve the Software. X1 does not collect, access, or store the customer content that you index, search, tag, or analyze with the Software, except content you voluntarily share with X1 for technical support. To repeat for emphasis: X1 does not sell, rent, or otherwise monetize your content, and does not use it for advertising, marketing, or AI model training.

Confidentiality and Privilege.

Because your content and your AI prompts remain within your environment during ordinary operation of the Software and is not accessed or stored by X1, the Software is designed to support your efforts to preserve the confidentiality of sensitive information and to maintain applicable legal protections, including the attorney-client privilege and the work-product doctrine.

AI Output; Accuracy and Responsible Use.

AI features rely on probabilistic models, and their output may be incomplete or inaccurate, including output that appears plausible but is incorrect (sometimes called “hallucinations”). AI output is provided “as is” for informational purposes only, does not constitute legal, compliance, or other professional advice, and is not a substitute for the independent review and judgment of a qualified professional. You are responsible for reviewing and verifying AI output before relying on it, particularly for legal, regulatory, eDiscovery, or investigative purposes, and for ensuring that your use of the AI features complies with all laws applicable to you and your data.

INFORMATION SHARING AND DISCLOSURE

We do not sell or rent your personal information. We only share your information under the following circumstances:

Required Disclosures: We may disclose your information when required by law, regulation, or government request.

DATA SECURITY

We take the security of your information seriously. We use industry-standard encryption and security measures, such as SSL encryption for data transmission and robust access controls, to protect the data processed through X1 Search.

CHANGES TO PRIVACY POLICY

X1 reserves the right to change this Privacy Policy at any time and will do so by posting changes to this Privacy Policy on the Site. The new Privacy Policy will apply to all current and past users of the Site and will replace any prior Privacy Policies that are inconsistent.

DISPUTE RESOLUTION; INTEGRATION

This Privacy Policy shall be governed by and construed in accordance with the laws of the State of California applicable to agreements made and performed in California, excluding the application of the conflict of laws provisions.
